LEGAL NOTICE — ekkeka
This Legal Notice governs the use of the website www.ekkeka.com (also accessible at www.ekkeka.co.uk) (the "Website"), owned and operated by Logan Webb, trading as "ekkeka" ("ekkeka", "we", "us" or "our").
It is issued with regard to the identification and information duties set out in regulation 6 of the Electronic Commerce (EC Directive) Regulations 2002, and Part 3A of the Consumer Rights Act 2015. The Website's contents are additionally governed by the UK GDPR, the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003 (PECR), to the extent that they apply.

Business structure: sole trader. As ekkeka is not a limited company, it is not registered with Companies House and has no company registration number.
Activity: online retail sale of clothing, accessories and related products.
Our commercial relationships with consumers who buy through the Website, wherever they are located, are governed by ekkeka's Terms and Conditions of Sale and by the applicable law set out in that document.
2. Purpose and scope of the Website
The Website exists to: (i) provide information about ekkeka, its brand and its products; (ii) enable the online purchase of products by consumers; (iii) provide customer service and complaints channels; and (iv) any other lawful purpose connected with running the business.
Simply browsing the Website makes you a "User" and means you accept this Legal Notice, and, where relevant, our Privacy Policy and Cookies Policy (published separately). Where you register an account, or buy a product, our Terms and Conditions of Sale, Returns and Exchanges Policy, and Shipping Policy also apply.
If you do not agree with this Legal Notice or with any of the other policies referred to in it, please do not use the Website.
3. Acceptable use of the Website
When using the Website, you agree to act lawfully, in good faith, and in line with this Legal Notice, and in particular not to:
- use the Website for an unlawful purpose, or in a way that harms the rights of others or is contrary to good faith;
- post or share content that is discriminatory, offensive, pornographic, violent, defamatory, threatening, or otherwise breaches the rights of others;
- introduce viruses, malware, or other code or files that could alter, damage, interrupt or interfere with the Website or its operation;
- try to access restricted areas of our systems without authorisation, bypass security measures, reverse-engineer any part of the Website, carry out large-scale automated scraping, or attempt a denial-of-service attack (conduct which may also constitute an offence under the Computer Misuse Act 1990);
- use content from the Website for advertising, commercial or other exploitative purposes, in any medium, without our prior written permission;
- impersonate another person or organisation, or provide false, inaccurate or incomplete information, or use someone else's identity without their consent.
Breaching these conditions may lead to your access to the Website being suspended, your account being closed, and, where appropriate, legal action being taken.
4. Intellectual property
All content on the Website — including, without limitation, text, photographs, videos, graphics, designs, source code, layout, navigation, databases, trade marks, trade names, logos and other distinctive signs — belongs to Logan Webb (trading as ekkeka), or to third parties who have authorised its use, and is protected under the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, and related UK intellectual property law.
We do not grant you any licence to use our intellectual property beyond what is needed to browse and shop on the Website for your own personal use. You may not reproduce, distribute, publicly communicate, adapt, decompile, systematically extract, or otherwise reuse the Website's content, in whole or in part, without our prior written consent. Framing the Website, or using any technique that alters its original design, layout or content, is also prohibited.
You may quote or reproduce short extracts of our content for lawful, non-commercial purposes (for example, information, teaching or research), provided you: (a) keep the content intact and unaltered; (b) clearly credit ekkeka as the source; and (c) do not use it in a way that is incompatible with, or competes with, our business.
Unauthorised use of our intellectual property may result in legal action. If you believe content on the Website infringes intellectual property rights you own, please contact us at hello@ekkeka.com, following the process set out in section 7.
5. Links
5.1 Links from the Website to other sites
The Website may contain links to third-party websites. We do not control those websites or the content, products or services offered on them, and accept no responsibility or liability for any loss or damage arising from your use of them. A link does not imply any relationship, endorsement or agreement between ekkeka and the owner of the linked site.
5.2 Links from other sites to the Website
If you link to the Website from another site, you must: (i) not suggest any relationship, sponsorship or endorsement by ekkeka that does not exist; (ii) not link from a page containing unlawful content, or content that breaches the rights of others; (iii) not reproduce our trade marks, logos, trade names or other distinctive signs without our written permission; and (iv) link to the Website's homepage, rather than framing it or deep-linking in a way that misrepresents its content. We may ask you to remove a link to the Website at any time, without needing to give a reason, and expect this to be actioned promptly.
6. Liability
We take reasonable care to keep the Website running, up to date, secure and free of errors. However, we don't guarantee uninterrupted or error-free access, or that content is always current, and — to the extent permitted by law — we won't be liable for loss or damage arising from:
- interruptions, outages or failures in the Website, unless these result from our negligence;
- typographical or factual errors in the Website's content, though we will correct these as soon as we reasonably can once we're aware of them;
- your use of an outdated browser, malware on your own device, or an insecure network connection;
- content posted by third parties (for example, customer reviews) that is outside our editorial control, subject to the notice-and-takedown process in section 7.
Nothing in this Legal Notice excludes or limits our liability where it would be unlawful to do so — for example, for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer.
7. Reporting unlawful content
If you believe content on the Website is unlawful, breaches your rights, or otherwise breaches applicable law, please contact us at hello@ekkeka.com or by post at the address in section 1. Please include, where possible: (i) a clear explanation of why you consider the content unlawful; (ii) its exact location on the Website (for example, a URL); (iii) your contact details; and (iv) confirmation that your report is made in good faith.
We will acknowledge your report, review it promptly and fairly, and take appropriate action, which may include removing or disabling access to the content in question. We will let you know the outcome and, where relevant, explain what options are available if you disagree with our decision.

How we handle personal data collected through the Website is set out in our Privacy Policy, prepared in line with the UK GDPR and the Data Protection Act 2018. Our use of cookies and similar technologies is set out in our Cookies Policy, in line with the Privacy and Electronic Communications Regulations 2003 (PECR). Please read both before using the Website or providing us with any personal data.

We may update this Legal Notice from time to time to reflect changes in the law, in our business, or in how the Website works. Updates take effect once published on the Website, so it's worth checking back periodically. The date of the last update is shown at the end of this document.
10. If part of this Legal Notice is found to be invalid
If any provision of this Legal Notice is found by a court or regulator to be invalid, unenforceable or unlawful, the rest of the Legal Notice will continue to apply in full.
11. Governing law and jurisdiction
This Legal Notice is governed by the law of England and Wales, without prejudice to any mandatory consumer protections you're entitled to under the law of the country where you live, where these are more favourable to you.
Any disputes arising from the use of the Website will be subject to the non-exclusive jurisdiction of the courts of England and Wales, meaning that, if you live elsewhere in the United Kingdom or in another country, you may also be able to bring proceedings in the courts of the place where you live.
